Terms of Service (TOS)

1. Acceptance of Terms

By accessing or using the KenOmega.io platform (“Platform”) at kenomega.io, you agree to be bound by these Terms of Service. If you do not agree, you must not use the Platform.

Definitions: “KenOmega.io”, “Ken Omega”, and “kenomega.io” (collectively, “KenOmega.io”, “we”, “us”, or “our”) refer to the operator of the Platform.

2. Eligibility

You must be at least 18 years old to use this Platform.

By using the Platform, you confirm that you meet this requirement and have the legal capacity to enter into this agreement.

3. Platform Overview

The Platform is an NFT-gated KenOmega.io experience designed for:

• XRPL token swaps and related dApp features
• Educational experimentation with blockchain technologies
• Limited-value cryptocurrency interactions

Access to certain features may require ownership of a qualifying NFT. That NFT ownership may grant access to the KenOmega.io platform features as described on kenomega.io. You are responsible for providing and securing any wallets, devices, or hosting environments you use to interact with the Platform.

4. No Refunds

All sales are final. No refunds.

This includes (without limitation) purchases of any KenOmega.io NFT (which may grant access to the KenOmega.io platform), as well as any fees or token payments made in connection with Platform usage — including payments in $KEN.

You acknowledge that blockchain-based transactions are typically irreversible and may involve third-party marketplaces, wallets, and networks outside of our control.

5. Cryptocurrency Features & Limits

To promote responsible use and reduce risk:

• Token Swaps: Limited to a maximum equivalent of $100 USD per transaction (or such other limit as displayed in the Platform)
• Token Sends (XRPL): Limited to a maximum equivalent of $100 USD per transaction (or such other limit as displayed in the Platform)

Swap platform fee: When you complete a token swap through the Platform, a platform fee of 0.5% of the swap’s value (expressed in USD) may be charged in addition to standard network fees. That fee may be converted to XRP using the Platform’s XRP/USD reference at the time the fee payment is sent, and paid as a separate XRP Ledger transaction to a designated fee wallet. As market conditions change, the swap fee percentage may be adjusted up or down by KenOmega.io (including via server configuration).

Approx / displayed swap quotes: Estimated amounts shown in the Platform (including “Approx … Received”) for XRPL AMM pairs such as XRP / RLUSD, KEN / RLUSD, KEN / XRP, and KEN / AGENTIC are derived from on-ledger AMM pool quotes. Those quotes already incorporate each pool’s trading fee. As a result, Approx figures may differ slightly from centralized-exchange spot or futures prices even before any separate Platform swap fee above. AMM pool fees and depths can change over time.

The Swaps and Sends limits are enforced to:

• Discourage misuse or illicit activity
• Protect inexperienced users from significant financial loss

You acknowledge that all blockchain transactions are irreversible.

6. $KEN Utility & Platform Features

$KEN is the utility token of KenOmega.io on the XRP Ledger (XRPL). The Platform may require or accept $KEN for certain features, access flows, or ecosystem experiences as described on kenomega.io and in the $KEN Whitepaper.

• Utility: Platform-aligned uses include general utility within KenOmega.io products and dApps, rewards, and possibly governance (in the form of votes) regarding certain platform features that are undetermined at this time.
• No guarantee of value: Holding or using $KEN does not guarantee profit, passive income, or any particular market price.
• On-chain verification: Always verify token details, supply, and account status on a trusted XRPL explorer.

7. Acceptable Use Policy

You agree NOT to use the Platform to create, distribute, or promote:

• Illegal or fraudulent content
• Malicious code, exploits, or harmful activity
• Harassment, abuse, or threatening language
• Sexually explicit or pornographic content
• Hate speech or discriminatory content
• Politically subversive or destabilizing messages, targeting any nation or sovereignty
• Misleading, deceptive, or scam-related content

You agree, especially regarding any software, scripts, or client interfaces provided for the KenOmega.io platform (the Software), NOT to alter or attempt to alter the Software in ANY way. If you alter or even “attempt” to alter the Software, your wallet and/or NFT access may be strictly banned from further use of KenOmega.io platform functionality.

You can easily avoid access restrictions by abiding by these Terms of Service — which you agree to by using kenomega.io and any NFT-gated features of the KenOmega.io platform.

KenOmega.io reserves the right to remove content and restrict access at its sole discretion. Furthermore, wallet addresses and their associated NFTs may be banned at our discretion for misuse of the KenOmega.io platform, or violation(s) of these Terms of Service.

8. Risk Disclosure

You understand and accept that:

• Cryptocurrency and blockchain technologies involve financial risk
• Transactions are final and non-reversible
• Smart contracts and software systems may contain bugs or unexpected behavior
• Token prices and platform features may change without notice

Use of the Platform is at your own risk.

9. No Financial or Legal Advice

The Platform is intended for educational and experimental purposes.

Nothing on the Platform constitutes financial, investment, or legal advice.

10. Account & Wallet Responsibility

You are solely responsible for:

• Your wallet security and private keys
• Any transactions initiated from your wallet
• Ensuring compatibility with supported blockchain networks

KenOmega.io is NOT a crypto exchange. We do NOT custody any crypto. KenOmega.io does not have access to or control over your funds. KenOmega.io does not have access to your private keys. Your private keys are NEVER stored on KenOmega.io.

11. Intellectual Property

All Platform technology, branding, and systems remain the property of KenOmega.io.

By submitting content through the Platform (if applicable), you grant KenOmega.io a non-exclusive, worldwide license to process, display, and use your content within the Platform.

12. No Reselling

You agree by accepting these Terms of Service / Terms of use, NOT to resell or attempt to resell any KenOmega.io platform software, license materials, or proprietary client tooling (the Software) in ANY way, shape, or form, except where an NFT or token is freely transferable on open secondary markets by its nature — and then only for the NFT/token itself, not for unauthorized copies of the Software.

13. Service Modifications

KenOmega.io may:

• Modify or discontinue features
• Adjust transaction limits
• Update fees or token requirements

At any time, without prior notice.

14. Termination

We reserve the right to suspend or terminate access if you:

• Violate these Terms
• Engage in prohibited activity
• Attempt to abuse or exploit the system
• Modify or attempt to modify the Software
• Resell or attempt to resell the Software in any way, shape, or form

15. Limitation of Liability

To the fullest extent permitted by law:

KenOmega.io shall not be liable for:

• Loss of funds
• Missed earnings
• Smart contract failures
• Third-party blockchain issues
• Any indirect or consequential damages

16. Governing Principle

These Terms are intended to promote safe, transparent, and responsible use of emerging blockchain technologies and the KenOmega.io platform.

17. Changes to Terms

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
